Housing supervision; elimination of housing defects

The municipalities can take on the task of housing supervision on their own responsibility and support tenants in the elimination of housing defects.Description
The municipalities are responsible for housing supervision on the basis of Art. 83 of the Bavarian Constitution. The specific powers of intervention under housing supervision law (e.g. ordering the removal of defects) ceased to apply following the repeal of the Housing Supervision Act on 01.01.2005, as the legislator considered the civil law options under tenancy law and the security law instruments to be sufficient.
The municipalities have general public law powers under misappropriation, building regulations, health or general safety law at their disposal to take effective action against abuses and problem properties caused by neglect or abandonment of housing or overcrowding.
