Brief description
The obligation to connect to and use a public drainage system ensures proper public wastewater disposal.Description
If your municipality has provided for this in its drainage statutes, properties that are connected to a public drainage system must generally also be connected to this system and use it. This obligation is referred to as the so-called connection and usage obligation.The possibility of imposing such an obligation on property owners for reasons of public welfare is regulated by law in the municipal code (GO). Article 24 Para. 1 No. 2 GO allows the municipalities (which are obliged to dispose of wastewater in accordance with the Bavarian Water Act) to fulfill this task using this route. This provision forms the basis for the corresponding local regulations in the municipal drainage bylaws for ordering the compulsory connection and use.
Under certain conditions, however, property owners can also be fully or partially exempted from the obligation to connect or use the system. The conditions for this are usually regulated in more detail in the local drainage bylaws.
